Actually, it does. In the check_rbl_swe function, it makes sure the Habeas mark is present before it even checks the HIL. The reason you're seeing messages that triggered HABEAS_VIOLATOR but not HABEAS_SWE is that you've redefined HABEAS_SWE to only hit if HABEAS_FORGERY is not present.
