Looks to me like you are running with the -c switch in spamc_options. that way it passes the email to spamd and spamd returns only a score (x.x/5.5) to qmail-scanner. If x.x > 5.5 then it prepends the subject header, if no Subject: header exists, it doesnt prepend.
The check for Subject: header would need to preceed the prepend, and if Subject: does not exist, a "Subject: [SPAM]-Empty Subject" could be added faily easy. Without the -c flag to spamc, you will always gets a Subject: headers returned from spamd. this is way off topic however, please post follow-ups to the qmail-scanner list.
