xf86-video-dummy license clarification

Hi, Xorg’s dummy driver lacks a clear open source license statement[1]. Its COPYING file simply states “Copyright 2002, SuSE Linux AG”, indicating it is non-free software. Is that correct? I see Debian is distributing the driver under the terms of the X11 license[2], so is Gentoo Linux[3]. Thanks

Tigervnc in combination with video dummy driver

Is it possible to use some alternative to video dummy driver when I Am using Tigervnc? Or unfortunately, I can only use dummy video driver when I will run xinit not tivervnc? How complex would be to incorporate new video dummy feature to Tigervnc if is it not available for now? One memgber of this
