I am closing it because the bug has been fixed in the latest development
version of Kubuntu - 8.10, the Intrepid Ibex. Intrepid comes with KDE
4.1 by default, which has KWin 4.1 which isn't affected by this bug. It
won't be fixed in previous versions of Ubuntu because the package
doesn't fit the r

I'm pretty sure you're missing the point here.
In kate I can select the File -> open menu to display the file open dialog.
I can switch away from kate with and back again. As the file open
dialog is modal, switching to kate results in switching to kate with it's modal
dialog on top.

This functionality is intentional. The preferences and filter dialogs are both
modal windows, which don't allow focus to return to the main window until they
are closed. You'll notice that you can't even bring back focus to the main
window by clicking on it.
