It's easy to explain why you can't choose a bit rate. Flak, like WMA
lossless, is a lossless format and so it automatically chooses the bit rate
that will preserve the full sound quality. A variable bit rate is used to
ensure the best compression and file size and so what you're seeing

It depends how you've got your winamp set up. If the output plugin in
preferences plugins is set to wave output, the volumes will be the same. If
you switch that to direct sound output, winamp's volume is independant of
anything.
