The theme is designed to use a gradient image in the panel.
Removing it is the only option to fix this bug , hence setting it to wishlist.

I just emptied a Trash with a large number of files and iconized the
"preparing to empty the trash" ( or similar ) dialog. The window
completely vanishes and there is no tab in the window list for it to
bring it back.

perhaps a check could be made at launch and a message to that effect
given rather than operating with incomplete and incomprehensible
functionality?

I still have this issue. Now with Ubuntu 10.04 Lucid Lynx. Some emails are
