I observe this problem every time I am on my computer (empathy runs as an
Start-up application), so I never "enable and disable the empathy tray icon",
as you say.
In fact, I use a computer at work, with maverick as well, and it works the same
way, no minimization when I click on the system tray

When empathy is minimized I can click on the system tray icon and it maximizes,
showing my contacts list. But, when it's maximized, clicking on the system tray
icon doesn't minimize it :S (nothing happens). To minimize it to tray icon I

When I click on the main menu to shut down my laptop, it logs me out instead
