I observe this problem every time I am on my computer (empathy runs as an 
Start-up application), so I never "enable and disable the empathy tray icon", 
as you say.
In fact, I use a computer at work, with maverick as well, and it works the same 
way, no minimization when I click on the system tray icon (please find attached 
an image of the region of the screen I am talking about, just in case it has 
another name).
