Duplicate ad groups in one campaign

We've been getting this error when publishing ad groups with the same name in the same campaign -> DUPLICATE_ADGROUP_NAME. But the problem is, that duplicate ad group still goes through and gets published even if we see the error. After checking the AdWords UI, we do see the same ad groups with
