For bus bays the way is split twice, creating an extra segment. At that point it's easy to use left/right/both. This is the same principle that is used when tagging turn lanes near crossings. I'm sure there are people who don't like splitting ways in ever smaller pieces, but that ship has sailed. Emergency bays and bus bays are physically very similar, i.e. a short piece of an additional lane on a road. For dual lane traffic or for emergency bays on the "wrong" side of the road you need an agreed way to define which side of the road. I do not like the way approach of the emergency_bay tagging, as it actually requires a separate way, which does not reflect the reality on the ground. As both tags are so far relatively low-use, it may not be too late to unify the bus_bay and emergency_bay mapping approaches. Similar tagging scheme, yes, but with a big functional difference, that is, they appear on single-lane roads and can be used in both directions, independently of the side of the road they are on. My starting question was specifically for emergency bays on two-lane roads where, typically, you could not easily cross to the other side in case you have a technical problem. They are frequent here on heavy-traffic, two-lane (not dual-carriageway!) roads. They are also typically not placed in pairs on both side of the road across from each other, but staggered.
