The distance between the tire and fork crown is too large, and the L-bracket on the fender too short. Common problem on touring bikes. Fabricate some type of drop bracket to allow the top of the fender to sit closer to the tire. I usually use a piece of flat steel rack strut, of the type used on Blackburn, Topeak, and other racks. Bolt it to the fork crown and then bolt the fender to it. If you don't have any at home an LBS would probably have tons.
