No I have that's how I am able to run clamd as root when I run it as qscand then it fails

Doing chown alone won't make clamd run as qscand. Did you alter
/usr/local/etc/clamav.conf too?
it seems that files under /var/spool/qmailscan/tmp/emaildir/ are created as being root:vchkpw
