Two wrongs don't make a right: This being an issue un other packages too is not an argument that this one should be acceptable. If the licensing is considered DFSG-free, then defend that (not here in an email conversation discrete with ftpmaster, but) in a Comment field in debian/copyright file, and re-upload.
