I am always pleased to see that the confusing classifications for various 
biocides such as gasoline-diesel mixture against voles or natural gases like 
nitrogen or carbon dioxide also exist in the USA.

In Germany we also have a mobile device for voles called MAUKI,

In this device, the exhaust gases of a small four-stroke engine are 
additionally enriched by injecting a gasoline/diesel mixture into the exhaust 
tract.
This results in the roughly simplified following composition for the resulting 
carburetant:
Nitrogen, carbon dioxide, water, carbon monoxide, and a high proportion of 
unburned more or less volatile hydrocarbons.
Carbon dioxide, even more carbon monoxide and also the hydrocarbons are acutely 
toxic to mammals and lead to death when a sufficient concentration is reached.

As far as I know, the device is approved as a plant protection product, while 
the toxic gases produced in situ are not regulated.
Who is supposed to understand that!?

Just a quick clarification: Devices are regulated by EPA; you’ll see an EPA 
Est. No. on their packaging.



There’s typically some logic behind a regulation, but I’m not sure anyone’s 
still around who would recall the logic that led to regulating items such as 
the BurrowRx as a device and exempting the carbon monoxide it generates from 
the pesticide registration process. Overall, FIFRA and the resulting federal 
regulations work pretty well, so I’m leaning toward there having been a 
somewhat reasonable explanation for this. I’m just not sure what it was.

Yes, it is confusing and confounding. Perhaps someone from EPA might want to 
jump in to elaborate or  correct me. If one were to purchase a pressurized 
cylinder of CO for use as a pest abatement tool, that bottle would have to 
carry an EPA label. The BurrowRx machine (and others that operate similarly) 
are devices. The CO produced is a biproduct of combustion produced on site. The 
device itself is not regulated by EPA, nor is the effluent produced.



I’ve challenged EPA on this point. If I were to try to fill a burrow with water 
from a garden hose, technically that would not be a pesticide application. Ah, 
but what if I purchased water in a 5 gallon jug and used the contents to abate 
rats? Use of water would rarely be effective (unless you flood the entire area 
to drown the rats), so it is an academic question. I can’t imagine that EPA 
would rule that water would be a pesticide.



Neither you nor I drafted the regulations. If I did, they’d probably be even 
more confusing. But, we must adhere to these regulations whether or not we 
agree with them!

It is confusing. A piece of equipment that can generate a lethal agent, but is 
not sold with anything the agent is produced from, is considered a device, and 
thus does not need to be registered as a pesticide. An example is BurrowRx, 
which kind of looks like a lawn mower. It is not sold with gasoline. But when 
you add gas to it and turn it on, it generates carbon monoxide, which you can 
direct into rodent burrows to kill the rodents.



Not sure I get the logic, either, but that’s the way the regulations have read 
since the 1970s.

According to the views delivered from my contacts at EPA, nearly any substance 
that is used to kill, repel, or otherwise mitigate a pest may be considered to 
be a pesticide. This is particularly the case if the chemical is prepared 
elsewhere but is then transported and applied at another location. So, carbon 
dioxide (in bottled or frozen form) is definitely considered to be a pesticide 
if used for mitigating a pest. If it is used to put fizz in your soda, it is 
not a pesticide. In contrast, carbon monoxide generated as a product of 
combustion, even if used to mitigate a pest, is not considered a pesticide, as 
it is generated on site. According to this logic, argon, if used for the 
purposes of fumigation, would be a pesticide. I anticipate that EPA would 
require that the bottle of argon be labeled with a pesticide label and carry an 
EPA registration number.



Don’t ask me to support the logic of this distinction. I’m just a messenger who 
has had too many conversations on this matter with folks from EPA and from 
several state agencies.

Argon is not a pesticide.

You may see as analog to heat, cold, gama rays...

They are not pesticide,  but kill bugs using different  aproaches.
