According to Amazon.com, some of their MP3 files are an average of 256 bit rate. The word "average" means that some of the files have a variable rate, and the average of that variable rate comes to 256. This would also mean that some of the file might be less than 256 and some of the file might be more to come to an average of 256. They do this to help cut down on file size. When it says that some of the file might be less than 256, they really do not say how far below 256 they go with the bit rate. So your guess is as good as mine, but I would assume that they would definitely stay above 128. Now they also said that they do have some files that are totally 256 bit rate, but not all of them. I do not know if they are going to tell this information for each file or not, you will have to check out their web site.
