That's probably an omission/oversight - the header of the clause clearly includes OpenSolaris. I think if we went ahead and redistributed the nVidia driver and nVidia decided to kick up a fuss, we'd have reasonable ground for defending ourselves. I'm 99% certain the clause previously only stated Linux - someone has taken the time to add FreeBSD and OpenSolaris so its reasonably clear their intentions are for the drivers to be redistributable for open source operating systems. I'd say we should seek clarification, but assume it's now fine to redistribute it unless told otherwise. That's my interpretation anyway.
