i thank that the masking threshold dependent on the tonality of the signal   
    but  i read the patent and the paper
     so i ask why it depend on the signal power
    the M/S threshold  calculated  
    Nthrsum=MAX(Thrnsum,MIN(Thrndif,mlddif))
    Nthrdif=MAX(Thrndif,MIN(Thrnsum,mldsum))
   and the mld = M(S)spreading-energy*facter
  it look like only relative with the energy
