That code was definitely in 1.6.3-rc1. So this should be OK. Another thing we don't do, I now notice, is setting vau.index = 0;. Can you add that to all instances of VIDIOCGAUDIO and VIDIOCSAUDIO (there should be two code blocks doing something with the audio chip on your card) and see if that improves it? If that doesn't help, then it'd help if you could tell us what driver you use and what insmod options you're using in combination with it.
