The 38400 is only a "virtual" baud rate.  If you enable the "spd_vhi"
option with setserial, the 38400 baud will be automatically converted to
a rate of 115200.

That being said, there is no reason to use spd_hi or spd_vhi anymore. 
The Linux kernel allows the baud rate to be set directly to 57600 or
115200 if you desire.

I don't believe it either.  I bet something else changed..
Try changing it back to /dev/cua1 and see if it fails.  :)
