That appears to be almost verbatim the language in various CASL legislations etc.. always was a loop hole that you could drive a truck through.. eg, you 'could' make an argument that CEO's need little blue pills with all the stress they have.. so it might be related to their published job title.. and thus protected via implied consent.. <sic>
