You might want to look up a company called "Holomaxx". They sued Yahoo and Google under that theory and lost, badly. Threatening to sue ISPs because they don't accept your mail is What Spammers Do. There is no reason to believe that Hotmail's behavior is malicious, zero evidence that they are trying to put you out of business, and less than no reason to believe that legal threats will do anything except make people point at you, roll their eyes, and giggle.
