Miktex 2.9 or later is mandatory to compile LyX document but if LyX is used to simply generate LyX document (or LaTeX document) without compiling it, we should not forbid this use. So I would suggest to install LyX in all cases and if need be, to give the choice to the user either to upgrade himself properly Miktex (followed by a reconfiguration of LyX) or to let the LyX installer perform this Miktex upgrade.
