This *can* be changed. Instead of writing a lyx file, tex2lyx should ask
LyX to write it with current format. Or alternatively LyX could
integrate tex2lyx completely. The last solution is the best IMO. tex2lyx
was done in a time where LyX could not be launched without a GUI event
loop. This is not the case anymore since 1.5.x as is shown by the export
methods.
