for the time being you can use sideeffect of toc initialization bug -
if you close lyx with outliner open and launch it again outliner is behind
the window until you close/reopen it.
(at least on linux)

I'm not sure I understand what you mean by "close Lyx", is it use 'File
/ Quit' option (ctrl-Q) ? If yes, with Windows version, this closes also
the toc window? Or is it some other option ?
