Dan and I think it was Ed were both right in different ways: Dan is referring to getting the Repairman's Certificate. Yes you have to build 51% or more or the DAR or FAA man will say that you do not have enough experience in the building to be granted Repairman Certificate status for your plane.
The other standard that you guys are referring to is the standard of amateur built. If more than 51% of the aircraft being certified has been completed by others for hire, as paid assemblers, or the maker of the kit as examples, then the airplane must be certified under another Part like Part 23 etc...
