more info.. ok.. seems like if I replace the actual version of EnableCheckFactory with revision 859 does resolve the problem.
now the question is: where is exactly the problem (it must have been introduced aftwards, but appearently it is not introduced by the changes done by Andreas - as far as I figure it out) however..
