I personally do not know. But I am told by people I trust (e.g. Henri), that this issue was considered. Because it turns out that the people working on this were not dumb.

Sure, the EME keeps the details of the CDM and such sandboxing outside
its scope, an intentional decision by the W3C working group. Sandboxing
was raised.

There is a difference between rejecting the possibility of sandboxing and rejecting the requirement for sandboxing. Which one of those two (or neither?) are you talking about?
