I would recommend asking this on trademarks@a.o. I would also recommend two separate transactions. IIRC, the SGA language is not the right language for the trademark assignment. Some other template should be used. Also, I believe it is in the best interests of the Milagro trademark owner to make sure the podling is going to graduate before assigning the trademark, and the software needs to come in long before graduation.
