My understanding is that the FSF does not answer such questions, basically saying "do it and we'll see what we think and if we think it infringes our copyright, we'll let you know". The bottom line on legal issues such as this is that if somebody wants legal advise, they should consult an attorney, not a mailing list or newsgroup. Patent law as it relates to computer programs can be very complicated and not intuitive.
