I am not Mark, but I suggest that you talk to RMS. If you have messages giving past discussions of the issue, all the better. I suggested off-list so we don't waste time on-list with a flame war when we can probably get the problem solved. I would prefer to have the current situation blessed, so we don't have to do anything.
