Lot 212 #26795 Major-General Richard Bourke. CB. ALS. LETTER OF APPOINTMENT OF BENJAMIN MOODIE AND OTHERS AS JUSTICES OF THE PEACE dd 24th July 1828 ALS proclaiming Benjamin Moodie, Harry Rivers, Christiaan Michael Lind, Johannes Jacobus Tesselaar, & Francis Balston as Justices of the Peace in the District of Swellendam. Richard Bourke was the Lieutenant-Governor of the Eastern District of the Cape of Good Hope, acting as Governor for both the eastern and western districts from 1826 to 1828. Bourke appointed Benjamin Moodie and others as Justices of the Peace in the Swellendam district. Under Bourke's Governorship much was done to reform the old mercantilist system of government inherited from the Dutch East India Company at the Cape. This document, in stylistic legalese, clearly lays out the duties expected of them. Benjamin Moodie was a settler in the Colony of the Cape of Good Hope in 1817. He was effectively the 10th and last Laird of Melsetter and emigrated to the Colony to seek his fortunes afresh following the insolvency of the estate inherited from his father the 9th Laird. He was an active citizen, farmer, and businessman of the time, eventually obtaining a seat in the Legislative Assembly of the Colony. A transcription is available on request. Lot 213 #26818 Office of the Registrar of the Supreme Court. ALS. A COMMISSION TO BENJAMIN MOODIE. JP. dd. 5th March1829. Letter empowering him to take affadavits. The commission is for Benjamin Moodie, settler in the Colony of the Cape of Good Hope, and erstwhile Justice of the Peace in Swellendam, to take affidavits. This is the original document with the Seal of the Supreme Court of the Colony of the Cape of Good Hope. Lot 214 #26819 #26822 Colonial Office of the Colony of the Cape of Good Hope. ALS. LETTER OF APPOINTMENT FOR BENJAMIN MOODIE TO THE LEGISLATIVE COUNCIL of the Colony of the Cape of Good Hope. dd 2nd October 1851. And one other item. Original letter appointing Benjamin Moodie to his seat in the Colonial Legislative Assembly. A second item is included. This is a fair copy of an original ALS. This second item is a period copy of an original letter to Sir Harry Smith from Queen Victoria. At the date mentioned in the letter (1852), Sir Harry Smith was the Governor of the Cape of Good Hope. The rear page is the address to Sir Harry George Wakelyn Smith which runs out of space at the bottom of the page and the text "(Copy) (Signed) Victoria R" is thus shown at the top of the the first page. Then follows the warrant for Sir Harry Smith to execute his commission to admit Benjamin Moodie as a member of the Legislative Council of the Colony of the Cape of Good Hope. The name of Grey as the signatory of the letter "By Her Majesty's Command" is not to be taken as referring to Sir George Grey who was at that time Governor of New Zealand and did not appear in the Colony of the Cape of Good Hope until two years later in 1854. Lot 217 #26816 Benjamin Moodie. ALS. DOCUMENT DISCUSSING PROSPECTS FOR A PROPOSED 'COLONY OF NATAL'. c.1834 In 1834, a petition from Cape Town merchants asking for the creation of a British colony at Natal was met by the statement that the Cape finances would not permit the establishment of a new dependency. This document could be a draft of a letter or a speech intended to put the case for the colonisation of Natal. Moodie argues extensively that the new colony should in no way present any significant expense to the Cape Colony nor would any significant military presence be needed. Benjamin Moodie was a settler in the Colony of the Cape of Good Hope in 1817. He was effectively the 10th and last Laird of Melsetter and emigrated to the Colony to seek his fortunes afresh following the insolvency of the estate inherited from his father the 9th Laird.
