Hi Brian,

The main point of the GPSR, is traceability of products across the whole Union.
Your CE TCF will cover the requirements of Safety and EMC however there are a
few onerous requirements...

  1. There has to be a single point of contact or Authorised Representative
within the Union where Market Surveillance authorities from every country can
have access to your TCF if required.
  2. All products should be labelled for traceability, i.e.
Importer/Authorised Representative contact details, manufacturer contact
details and these have to be in the language of each country your product is
sold in.
  3. All safety relevant documentation has to be multilingual.

The Regulation is here...

Publications
Office<https://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:32023R0988>

Chapter III describes the Obligations of Economic Operators within the supply
chain.

Since this Regulation was announced there are companies who have set themselves
up as Authorised Representatives for non-EU (third country) manufacturers,
however if you have an EU Importer or Distributors, it probably makes sense and
will be cheaper, to use them as your AR.

Best regards,

Glyn Payne

Subject: [PSES] New EU Regulation, GPSR

Hello compliance colleagues,

I've just been informed that the General Product Safety Regulation (GPSR) is
replacing GPSD, which I knew nothing about.
So, mostly this is a head's up to others that this is coming:

General product safety regulation (2023) |
EUR-Lex<https://eur-lex.europa.eu/EN/legal-content/summary/general-product-safety-regulation-2023.html>

Here's a quick rundown of my take after perhaps 15 min speed read and a video
or two. This appears to be an effort to close the loops, gaps and exceptions
that were allowed with current CE labelling and compliance. The labeling regs
seem a little new to me, but I think anybody with a decent CE file that's been
recorded by a solid EAR (EU Authorized Representative), is already covered.
My firm has a good CE "TCF" file, and I've asked our EAR to confirm that we're
already covered for GPSR.

Here's my one question: is my quick take accurate?

Colorado Brian
