I see the same. Removing the blank line before ‘Item 2’ fixes it, and
the problem also depends on the sub-lists before, i.e., these both
export fine:
#+OPTIONS: H:0 toc:nil
* Item 1
* @@comment: comment for Item 2@@
Item 2
* Item 3

AFAICT, no. Though, is it your intent to have an empty headline with
‘Item 2’ as the body? If it’s meant as the headline then this also
avoids the problem:

This is just the inline equivalent of a ‘comment’ export block:
#+BEGIN_EXPORT comment […] #+END_EXPORT
IMO it’s a bit of a hack since it relies on the fact that there’s no
‘comment’ export backend (which is true until you load
‘ox-only-comments’ ;P), so I’m not sure this part should be
documented.
The inline syntax is documented throughout the individual exporters
(e.g. ASCII, HTML, LaTeX), but not at a general level. I think
generalizing some of text in the ‘Quoting ASCII text’ section would be
useful earlier.
