AIUI, code doesn't have to have Apache headers at the time of donation. The donation (technically, the grant) authorizes Apache to distribute the code under AL, but Apache does not now own the code, it only has a license (or a copy). So now, the code owner or an agent can re-license Apache's copy of the code under AL which I will help Judah do prior to IP Clearance, since it should have the headers before hitting the repo. FWIW, he could have replaced the headers prior to donation, which would have officially placed his copy under AL. But Judah was short on time so I think it will be easier for us to deal with headers in our copy. Personally, I am thankful for his patience in the process and don't really want to make it harder for him, or question the validity of his contribution on a public list like this. I did the best I could, given that I am not familiar with the history of his code, to make sure the donation wouldn't be DOA. You'll get your chance to scrub the code on the incubator list when it gets submitted for IP clearance. -Alex
