In the latest spanish law, distribution now legally means just using a
physical support [2]. Thus, GPLv2 might not be providing permission to
distribute it through non-physical means like the network. The latter
would be public communication instead, not distribution.

This has been the case in Germany for years: Distritubtion (Verbreitung) requires a physical object, providing a download falls under making available (öffentliche Zugänglichmachung), a special form of public performance (öffentliche Wiedergabe).

I don't remember anyone suggesting that this would disallow downloads of GPL'd software.
