It's not hard to come up with a scenario that involves distribution as
well as NDAs. For example, a business may hire an external consultant
to create a version of the program that understands the data format that
the business uses for its customer statistics. The business considers
their method of doing statistics a trade secret, so the make the
consultant sign an NDA. When the consultant is finished, he
*distributes* the finished application to his customer.
