Not all of the crypto restrictions have fallen away. You still have to register crypto with the government. It's not hard, and they can't deny you a license to export (today...), but you do have to do it. I believe that is one of the major stumbling blocks towards getting crypto out of non-US (but I wouldn't actually know). Also, CSS was designed to be export grade, but you still had to jump through lots of hoops to get it approved. In fact, the 40-bit limit is just what people noticed was the limit for getting crypto approved. It was never explicit government policy.
