There are NO guarantees that your mail will ever reach the recipients that the list server claims are members, and there's a great chance that people may have (un)subscribed in between your list request and your list post. It could *very* easily be argued, then, that if you _only_ wanted to send to those people, you would have done, and you just stated very clearly that you could have done.
