This is my first post and because I'm a law student I need to consult with my ethics teacher for advice on how I should be replying on the list. I do want to offer the general points of law, but IT IS NOT LEGAL ADVICE. :)_
Courts have construed the conveyance of coyprighted material and later attempts to revoke rights to "use" as unenforceable. In a case involving a company that did some special effects for a movie company that then failed to pay their bills, the court held the deadbeat company enjoyed a non-exclusive license to the copyrighted material. If people would like a cite I can supply it later. The parties were something like Cohen v. ?? Special Effects. I think it was a 9th circuit case. Possible implied license for copying, derivative use, or distribution of mailing list posts is an interesting legal question and also relates to the dejanews controversies of last year. I'll do some research on this and get back to the list. I would suspect there is case law on this point. BTW, are there other legally trained people on the list? cheers.
