There is not a decision yet, but it's looking grim. The U.S. 2nd Circuit court of appeals looks disinclined to regard compiled code as speech. They also seem to feel that fair use does not extend to digital copying. I'm sure all of us who use analog-encoded analog media to back up the analog data on our hard drives can breathe a sigh of relief at that jurisprudence. -- G.
