Well, as far as the free software movement is concerned, if they are trying to keep people from seeing and distributing their code, that is NOT A LEGITIMATE INTEREST. If they wanted to help out free software, they would distribute their code under a free software license. In other words, if their goal is to hoard software, and they want to find out the best way to "help out" and still hoard software, then they should be informed that the best way to help out is to release the source code.
