The patches are part of the packaging stuff, are linked to the code and would be affected. Being GPL means the whole code would be GPL. Of course it's not critical to modify it in dh-make, maintainers always have the chance to modify that text in their copyright files (I do), but this can lead to problems if they forget to do it.
