Well, actually I agree with you (hence the smiley), but in my opinion this should be solved in the rules. The rules should not encourage undesired behaviour. For this particular problem Byo-yomi is one solution, not counting time for pass is another. For the latter, of course, passing should still be done within a reasonable time but what is reasonable may still be quite long because (1) it provides an immediate opportunity to end the game and (2) if it is (ab)used before the actual game is over it gives a big advantage to the opponent (because he gets to move twice).
