As far as I understand those things are absolutely not related, oracle isn't suing because they use the JVM but because they are not and rolling their 'own JVM' which, so claims Oracle, violates some of 'their' patents. Clojure on the other hand is simply using the JVM, as Oracle provides it, and the interfaces they provide, something they of cause will not sue over as it is a entirely different thing.
