Yes, it is possible that Bacula developement could be affected by patents, but
unlikely IMO. I don't see much in Bacula that is not prior art, and hence
there isn't much that could be attacked for a patent violation.
Seeing how some companies find patents covering all sorts of stuff it's
only a question of time that someone will find something in bacula that
they claim to be patented. And the following situation might require
lots of money, even if the claims are finally judged to be irrelevant.
Patents have
existed a long time in the US and so far, they have not created a lot of
problems for open source. That doesn't mean I am for patents or that they
won't create problems for Open Source or Bacula.
Most people/companies that attack for IP and Patents want money, and there
just isn't any to pull out of Bacula.
I think you're wrong here... think about how many big bacula
installations you know about - and now hink what Veritas and Legato or
any of the server companies would charge for such a backup setup.
How much can you earn if you can "show" the management of the bacula
users that their software is illegal?
Anyway, if someone has a legitimate
patent complaint, I suppose our ultimate defense is simply to remove the
offending code.
That might not be the way the "opposition" would handle things, I'm afraid.
And this is the pessimistic (although not unrealistically so) way things
could develop.
