You bring up a valid point. Now that HTC Hero is out on Sprint here in USA, and the new Droid Eris on Verizon, we tested on both but were not able to see the app in the market when visiting the Verizon store. First thought was that the Android Os 1.5 showed old android market and android apps of prior sdk versions. So we changed minimum sdk requirement to "2" (1.1) but that did not help.
A quick check on your theory showed that we indeed had copy protection "on" for those apps that didnt show on Droid Eris or HTC Hero. However, those apps that had protection "off" appeared in all android markets including Droid, G1, Eris and Hero. I will change copy protection to "off" on applications in question and report my findings tomorrow. Regards.
