Personally, I liked the way this worked under the previous (I think) iteration of the criminal justice system, where noting (then finger- pointing) created a duty on the investigator to determine whether an infraction actually occurred, even if the answer was "no". That seems far more intuitive to me than the current system: it is entirely unambiguous whether or not the investigator has to do something. ~qenya
