Changes to the resilvering implementation don't necessarily require changes to the on disk format (although they could). Of course, there might be an issue moving a pool mid-resilver from one implementation to another.

With arguably considerably more ZFS expertise outside Oracle than in, there's a good chance the community will get to a fix first. It would then be interesting to see whether NIH prevails, or perhaps even a new spirit of "share and share alike".
