Yes, there is source, and as you note, it is indeed provided under
a BSD license.

It's the whole driver. I really don't know why you thought that
the source didn't exist, let alone not exist in an open form. If
you read through that code, you should be able to see that it
isn't a shim, either. I don't know why you would think it might be
a shim.

The source at the url you mention is David Gwynne's port
of the *BSD mfi driver to Solaris.

Can I assume that my "2008-07-26 post" was in fact two messages that
were sent to you and cc'd to zfs-discuss:
http://mail.opensolaris.org/pipermail/zfs-discuss/2008-July/049605.html and
http://mail.opensolaris.org/pipermail/zfs-discuss/2008-July/049607.html

If so, what's the problem? Both drivers are Open. Both drivers are
provided under BSD licenses. Both drivers are, to the best of my
knowledge, "the complete source". Only one has been integrated into
OpenSolaris.

And finally, no, you won't get source for the version which is
integrated into a Solaris 10 Update. It shouldn't be too different
from the version which is in OpenSolaris, but nobody has ever
claimed otherwise. Is this the heart of the problem?
