You can't set NFSV4 ACLs over NFSv3, it only understands POSIX draft ACLs. When you see getfacl work that is only because it is fabricating an ACL based on the mode bits of the file. Its not a real ACL. Also, remember that NFSv3 doesn't officially support ACLs.
